Motorbike Swerve Test

Hutcheon Solicitors have received instructions to consider a motorbike accident claim under the new "swerve test" implemented by The Driving Standards Agency (DSA) who have been set up to reduce the number of riders and drivers killed or seriously injured in road accidents.

Paradoxically the new swerve test may increase the number of accidents and have come under fire with complaints that the test is dangerous for the inexperienced and novice rider.

The new swerve test involves learners being forced to reach 50km/h (31.2mph), then perform a swerve, on special test centre tracks to mimic avoiding things like debris on the road. However some riding instructors have concerns that if the riders brake and swerve at the same time they are likely to come off, particularly in wet conditions.

The BBC have reported that in since the test was brought in at the end of April 2009, in the first three and a half weeks there were 15 incidents during the exam with at least one rider left with broken bones.  It was reported by the Motorcycle Action Group that they advised the Government that the test was unsafe and asked for changes.
