Motorbike Swerve Test Accident Claims

Hutcheon Solicitors have received instructions to consider a motorbike accident claim under the new "swerve test" implemented by The Driving Standards Agency (DSA) who have been set up to reduce the number of riders and drivers killed or seriously injured in road accidents.
Paradoxically the new swerve test may increase the number of accidents and have come under fire with complaints that the test is dangerous for the inexperienced and novice rider.
The new swerve test involves learners being forced to reach 50km/h (31.2mph), then perform a swerve, on special test centre tracks to mimic avoiding things like debris on the road. However some riding instructors have concerns that if the riders brake and swerve at the same time they are likely to come off, particularly in wet conditions.
The BBC have reported that in since the test was brought in at the end of April 2009, in the first three and a half weeks there were 15 incidents during the exam with at least one rider left with broken bones. It was reported by the Motorcycle Action Group that they advised the Government that the test was unsafe and asked for changes.
Mr Ronnie Hutcheon, Principal Solicitor in the firm of R James Hutcheon Solicitors has obtained instructions from a leaner rider who fell off his bike and was injured whilst performing the "swerve test" under examination conditions. An accident compensations claim against the DSA in being considered for injury and loss of earnings as their client has been unable to return to work since the accident.

Judgment
Mr Justice Leveson
1 At about 7pm on 14th December 2000, Mr Thomas Collins was riding his bicycle home along Newington Butts, in the direction of Elephant and Castle in South London. Although slightly inaccurate, in common with the convention adopted throughout this trial, I will refer to this direction of travel as northbound. His home was in a block of flats on the offside of the road, reached through Hampton Street, which provides access to bicycles only. Hampton Street cannot lawfully be reached directly from the northbound carriageway of Newington Butts, because no right turn is permitted by that junction. At the start of these proceedings, how Mr Collins came to be cycling across Newington Butts to reach Hampton Street was in issue, but what is clear is that as he did so, he was struck by a London bus. Unfortunately, he was not wearing a helmet and he suffered serious head injuries. In the proceedings commenced for damages for personal injury, this hearing has been devoted to issues of liability.
