Mair v Payne

M sought damages from P, a driver, for injuries sustained in an accident. At the time of the accident, M, who had been riding pillion, was 21 years old and P was aged 19. P was uninsured and the action was intimated to B, the Motor Insurers' Bureau. M sought declarator that B were liable to satisfy any decree pronounced against P. At preliminary proof, M denied B's averments that they were not liable because he knew P did not hold a licence or insurance, submitting inter alia that he had only known P for two to three years prior to the accident, having met at a mountain bike shop where P worked, and further, that the onus of proof lay on B

1 On 1 September 2002, the Claimant, Kunal Lindsay, was riding a motorcycle along the A44 road. The Defendant, driving a car in the opposite direction, turned to the right in front of him. In the ensuing collision, the Claimant suffered serious brain injuries. The Defendant's insurers have admitted liability in full, and unless a settlement is reached in the meantime, the issue of quantum is to be tried on 26 February 2007. It is now common ground that as a result of his injuries the Claimant will never work again. The damages awarded are likely to be very substantial indeed.

1. On 25th August 2006 the appellant pleaded guilty at Swindon Magistrates Court to one offence of dangerous driving. He was committed to the Crown Court for sentence and on 10th October 2006 at Swindon Crown Court he was sentenced to eight months' imprisonment by His Honour Judge Longbotham. In addition he was disqualified from holding or obtaining a licence for a period of three years and until he had taken an extended driving test. He appeals by leave of the single judge against the length of the disqualification only.

Damages—Interim damages

The pursuer enrolled a motion for interim damages. He had suffered a motorbike accident which was the sole fault of the defender. He received injuries including a fractured skull and a severe diffuse concussional brain injury, suffering a change in personality, and other symptoms associated with head injuries as well as a fractured pelvis with associated pain and disability. The pursuer argued that the value of the claim for interim damages purposes should be £464,000 and sought an interim payment of £250,000 and the defender suggested the sum of £203,000 for the value of the claim and suggested an interim payment after deduction of the sum of £38,000 already paid, of £42,000. In holding that the value of the claim would not be less than £400,000 and assessing the interim payment at £162,000 after deducting the sum of £38,000 already paid the Lord Ordinary issued the following opinion on 1 July 2005.

Lorry Driver Flees Motorbike Accident Scene After

A motorcyclist has sadly died in another serious collision with a lorry on the A4042. The motorcylist, Christopher Jones aged 57, was taken to the Royal Gwent Hospital, where he later died. The lorry driver, a 43-year-old man from Ross-on-Wye, was arrested on suspicion of causing death by dangerous driving but was later released on police bail.
