Oliver v Calder

Abstract: Damages assessed. O, a schoolboy, aged 13 at the date of the accident and 14 at the child settlement approval hearing, was injured when the car in which he was sitting was hit on the driver's side by a motorbike. This side on collision from the right shunted O to the left. He was examined by his GP the day after the accident and was diagnosed with a whiplash injury. He was given advice and painkillers. The neck discomfort resolved within 10 days. O took two days off school and one week off PE. He suffered mild travel anxiety, being slightly nervous sitting in a car. On examination three months after the accident that anxiety was less marked and it was expected to have resolved completely within a few months, which it did. General Damages (agreed and approved): £1,000.
