Motorbike Overtakes At Bend
Whilst motorbike accident solicitors are often critical of motorist who fails to appreciate that a motorcyclist has just as much right to be on the road than the motoring counter-part there are times when a motorcyclist does act recklessly or carelessly.
The case in point below where we have illustrated a dangerous manoeuvre. Here the motorcyclist overtakes a car on a bend. This is in breach of the Highway Code not just for motorbike riders but also to motorists.
In fact this manoeuvre is similar to the sketch where the motorbike rider swerves to avoid a motorist who crosses white lines dividing lanes.
In this scenario the motorbike rider will be deemed to be negligent. If the motorists in injured as a result of the motorbike rider’s actions, then the motorist will have a claim for compensation. The motorbike rider will be 100% at fault in our view.
